Statutory right of withdrawal and voluntary 30-day return policy

A consumer is any natural person who enters into a legal transaction predominantly for purposes that cannot be attributed to their commercial or self-employed professional activity.

This English version is provided for convenience. Where legally permissible, the German version shall prevail in the event of discrepancies.

Voluntary 30-Day Return Policy

In addition to the statutory right of withdrawal described below, we grant consumers in Germany, Austria and Switzerland a voluntary return period of 30 days from receipt of the goods.

The period begins on the day after you, or a third party designated by you who is not the carrier, takes possession of the last item in your order. If the final day falls on a Saturday, Sunday or officially recognised public holiday at the relevant place, the period ends at the close of the following business day.

To exercise the voluntary return option, notify us within the return period by an unequivocal statement. You may use our electronic returns function or email retoure@novawear.de.

You must then return the goods without undue delay and no later than 14 days after your return notice to:

You bear the direct cost of returning the goods. This does not apply where the goods are defective or incorrect and we are legally required to bear the return cost.

For returns declared only after the statutory withdrawal period has expired, the goods must be complete, unwashed, undamaged and not worn beyond a normal fitting. Where the goods were supplied with labels, these should still be attached or included.

After receipt and inspection, we will generally refund the purchase price paid for the returned goods using the same means of payment used for the original transaction. Original delivery charges are not refunded for a voluntary return made after the statutory withdrawal period.

Your statutory rights remain fully unaffected. The additional conditions above apply only to the voluntary return option after the statutory withdrawal period has expired.

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day

• on which you, or a third party designated by you who is not the carrier, takes possession of the goods, where one or more goods ordered as part of a single order are delivered together;
• on which you, or a third party designated by you who is not the carrier, takes possession of the last item, where several goods ordered as part of a single order are delivered separately;
• on which you, or a third party designated by you who is not the carrier, takes possession of the final partial shipment or the final piece, where one item is delivered in several partial shipments or pieces.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement – for example by letter, email or through the electronic withdrawal function in our online store:

You may use the model withdrawal form below, but this is not mandatory. To meet the deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

You may also exercise your right of withdrawal online. Open the function, enter the email address used for your order and follow the steps shown. A password-protected customer account is not required.

WITHDRAW FROM CONTRACT

After entering the required information, submit your declaration using the confirmation function “CONFIRM WITHDRAWAL”.

If you use this online function, we will immediately send you confirmation of receipt on a durable medium, such as by email. The confirmation will contain the substance of your withdrawal declaration and the date and time it was received.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including the cost of the least expensive standard delivery offered by us, without undue delay and no later than 14 days after the day on which we receive your notice of withdrawal. Additional costs resulting from your choice of a different type of delivery are not reimbursed.

We will make the reimbursement using the same means of payment as you used for the original transaction, unless expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent the goods back, whichever occurs first.

You must return or hand over the goods without undue delay and no later than 14 days after the day on which you inform us of your withdrawal to:

The deadline is met if you send the goods before the 14-day period has expired. You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply, in particular, to contracts for the supply of goods that are not prefabricated and for which an individual choice or decision by the consumer is decisive for their production, or which are clearly tailored to the consumer’s personal needs.

This only concerns goods genuinely made or personalised according to individual customer specifications. The production of a regular NOVAWEAR standard item after an order is placed does not by itself automatically exclude the right of withdrawal.

For sealed goods that are unsuitable for return for health protection or hygiene reasons, the right of withdrawal may expire prematurely if the seal is removed after delivery. This applies only where the relevant product was actually supplied with an appropriate seal and the statutory requirements are met.
